The following Terms and Conditions (Items 1- 23 inclusive) govern the use of the CanCertain Ltd website and apply to persons or corporate identities purchasing any of the CanCertain Ltd’ tests or services or products. The website is owned and operated by CanCertain Ltd and these Terms and Conditions apply as from 15 May 2017.

CanCertain Ltd reserves the right to amend or update such terms, conditions, policies, disclaimers and limitations of liability at any time without providing notice to you. Your usage of the website and placement of an order for a test and/or service and/or product, indicate you acknowledge that you have read and understood these Terms and Conditions and agree to be bound by these Terms and Conditions.

1. Privacy Policy:
CanCertain Ltd recognise the critical importance of privacy issues. This Privacy Policy tells you how we collect, use, disclose, transfer, store and
manage the personal information that we collect, use, hold and disclose and how to contact us if you have any queries. We comply with all the applicable privacy laws and we are committed to take all reasonably available measures to protect your privacy. By visiting our website and/or providing personal information to us, you consent to the terms and conditions in this Privacy Policy unless you tell us to the contrary by following the instructions contained on our website or by contacting our Registered Office in writing.

2. Updates to Privacy Policy:
We may amend this Privacy Policy at any time, and from time to time. If we do so, we will post the amended Privacy Policy on our website so that you will always be aware of how we manage your personal information. The Privacy Policy is also available upon request to our Registered Office.

3. What personal information we collect:
The personal information you give us when you request a product or service or information from us will identify you and make the provision of the service you request possible. It will include your name, address, telephone numbers, email address, communications between you and us and
transactional information about your use of our products and services (for example your feedback on what you thought about our service). Additionally, your nominated Health Practitioner gathers and submits your medical history, medical experts will provide opinions about your test results, and the test results themselves are collected and stored by us. Sensitive information such as your health information may only be collected if you consent to it or when required by law. Relevant health information is required by us when you complete a CanCertain Ltd Test Request. If the test or product or service is a part of a clinical trial, CanCertain Ltd will collect, process and store personal and medical information as detailed in the clinical trial consent and will take all reasonable efforts to safeguard that information as required by applicable law. In the course of conducting our test procedures it is necessary for a sample of your blood or sometimes one or more small pieces of tissue to be used for testing. CanCertain Ltd sets out specific consents pertaining to the use of your blood, tissue samples and test results. These Consent Forms are part of the Test Request process should you choose to select those services from us.

4. Where and how your personal information is stored:
Your personal information is securely stored according to appropriate standards for hardware and software and secure transmission of data, including authentication. We take reasonable steps to preserve your personal information from loss, unauthorised access, modification or disclosure. Unfortunately, no data transmission over the Internet can be guaranteed as totally secure. Accordingly, although we strive to protect such information using best practices, we cannot ensure or warrant the security of any information you transmit to us or from our online products or services and you do so at your own risk. Once we receive your transmission, we take reasonable steps to preserve the security of the information in our own systems.

5. How your personal information will be used:
We collect your personal information so that we can use it to provide our services or information or tests to you, which include, amongst other things: providing your test service; notifying you of the progress of your test request; providing test results to the Health Practitioner/s nominated by you; providing an expert opinion on your test results; collecting payment from you for services or goods we supply to you; addressing any feedback or complaints you may have; answering any queries you may have; developing and marketing our products and services; conducting research about our products and services; providing information about our services and business. If you do not provide us with your personal information, we will be unable to do one or more of the above.

6. Exchange of personal information with third parties:
Personal information we collect from you may be disclosed: to any entity to which we are required or authorised by or under law to disclose such information (for instance, law enforcement agencies and investigative agencies, courts, various other government bodies); your medical team; medical laboratories; or with your consent (expressed or implied) to others. Such disclosure may include the transfer of your personal information between United Kingdom and other countries. You consent to your personal information being disclosed to these overseas recipients unless you advise our Registered Office. Please note that if you do not authorise us to transfer your personal information, it may limit the services we can provide to you or may prevent us from supplying services to you. We may also obtain personal and other information from some or all of the third parties listed above to enable us to provide our services or products to you. When we obtain personal and other information from third parties whom we are referred to by you, we will assume and you will ensure that you have made that third party aware of the referral of the persons and purposes involved in the collection, use and disclosure of the relevant personal or other information.

7. Use and disclosure of personal information by us:
If we use or disclose your personal information for a purpose (the “secondary purpose”) other than the main reason for which it was originally collected (the “primary purpose”), to the extent required by law, we will ensure that: the secondary purpose is related to the primary purpose of collection (and directly related in the case of sensitive information), and you would reasonably expect that we would use or disclose your information in that way; or you have consented to the use or disclosure of your personal information for the secondary purpose; or the use or disclosure is required or authorised by or under law; or the use or disclosure is otherwise permitted by law (for example, as a necessary part of an investigation of suspected unlawful activity).

8. Collection of information other than personal information:
Website Visitors: Like most website operators, CanCertain Ltd collects some non-personally identifying information of the sort that web browsers and servers typically make available, such as the browser type, language preference, referring site, and the date and time of each visitor request. Our purpose in collecting non-personally identifying information is to better understand how our visitors use our website.

9. Collection of personal information from children:
CanCertain Ltd hosts a general audience site and does not knowingly collect personally identifiable information from children under the age of 18 without verifiable parental consent. If you are under the age of 18, please do not provide us with personally identifiable information of any kind whatsoever. If your child provides us with personally identifiable information, you may contact our Registered Office to delete this information from our records.

10. Access and correction of your personal information:
You can ask to obtain access to your personal information that we hold, although under some circumstances permitted by law, we may not provide such information to you. We may ask you to put your request in writing and pay a reasonable fee levied by us for providing you with the information you have requested. We may also ask you to provide us with some proof of identification before releasing or correcting your personal information. It is important to us that the personal information we hold about you is accurate, complete and up-todate. If you are aware that this is not case and would like to correct your personal information, or simply desire access to your personal information, please contact our Registered Office. We will deal with your request within a reasonable time and, if we decide not to correct or provide you with access to your personal information, we will give you our reasons for our decision.

11. Site Security Policy:
We have implemented technology and security policies, rules and other measures to protect the personal data that we have under our control from unauthorised access, improper use, alteration, unlawful or accidental destruction, and accidental loss. We also protect your information by requiring that all our employees and others who have access to or are associated with the processing of your data respect your confidentiality. We use security methods to determine the identity of registered users, so that appropriate rights and restrictions can be enforced for that user. Reliable verification of user identity is called authentication..

The content of this website is under copyright and is the property of CanCertain Ltd. Material on this website also comprises copyright material, trademarks and registered trademarks which are the property of CanCertain Ltd and third parties. This property may only be used for the purposes of browsing this website and ordering tests and/or services and/or information and/or products. The content of this website may not be copied, reproduced, republished, downloaded, posted, broadcast or transmitted in any way without first obtaining our written permission or that of the copyright owner. Third party videos and documents on this website are the responsibility of individual authors and the views contained within said videos and documents do not necessarily represent the views of CanCertain Ltd.

13. Cookies:
A cookie is a string of information that a website stores on a visitor’s computer, and that the visitor’s browser provides to the website each time the visitor returns. CanCertain Ltd uses cookies to help us identify visitors. Our visitors who do not wish to have cookies placed on their computers should set their browsers to refuse cookies before using our website, with the drawback that certain features of this website may not function properly without the aid of cookies.

14. Employees:
Employees are required to keep your information private as a condition of their employment with us. Only selected, authorized employees are permitted to access health information. All employees and contractors must abide by our Privacy Policy, and those who violate that policy are subject to disciplinary action, up to and including termination of their employment and legal action.

15. Method of Sale:
Persons and/or corporates can purchase a test and/or service and/or products by Contacting us and providing the required information and their payment method details. We do not store any of your credit card details.

16. Method Of Payment:
CanCertain Ltd only accepts full payment in advance for tests and services provided Should you have any questions, please contact our registered office.

17. Complaints:
If you have a complaint about the way we have dealt with your personal information, please contact us via email at: info@cancertain.com. We will make all reasonable attempts to respond to your complaints or requests within a reasonable time after the complaint or request was made.

18. Test Results:
CanCertain Ltd will only email the Clinical Test results to your nominated Health Practitioner. All details will be treated as strictly confidential. In cases of Pre-clinical testing services CanCertain Ltd will provide results at the pre-agreed terms.

19. Receipt Of Test Results:
Different tests and/or services will have different turn around times. CanCertain Ltd endeavours to inform you at the point of sale of service/test the time frame within which you should expect the receipt of test results.

20. Shipping Policy:
20.1 UK Shipping Policy:
Where required, specialised tests Kits will be dispatched within twenty-four hours once full payment has been received and processed. For Test Requests where payment has been received on a Saturday, Sunday or Public Holiday, Test Kits will be shipped on the next working day. It is your obligation to enter the correct delivery address details at the time of ordering. Should you enter the wrong address, CanCertain Ltd is not obligated to re-send the order to the correct address at it’s own expense. An additional charge will apply to cover the cost of administration, freight and replacing the Test Kit.

20.2. International Shipping Policy:
Where required, specialised tests Kits will be dispatched internationally within twenty-four hours once full payment has been processed. For Test Requests where payment has been received on a Saturday, Sunday or Public Holiday, Test Kits will be shipped on the next working day. It is your obligation to enter the correct delivery address details at the time of ordering. Should you enter the wrong address, CanCertain Ltd is not obligated to re-send the order to the correct address at it’s own expense. An additional charge will apply to cover the cost of administration, freight and replacing the Test Kit. PLEASE NOTE THAT A POST OFFICE BOX CANNOT BE USED AS A DELIVERY ADDRESS. On occasion, some shipments may take longer to arrive, depending on the amount of time it may take for a Test Kit to clear the country of destination’s Customs and/or the location of your delivery address e.g. you may have a remote delivery address outside the international freight carrier’s network. On rare occasions the Customs Agency within the destination country may choose to delay individual shipments as a random security measure, these delays can take up to two weeks. The responsibility for any charges or fees such as Custom’s duties, foreign taxes or other fees / ssociated with the transportation of the Test Kit will rest with you the customer. It is the responsibility of you the customer to inform CanCertain Ltd if an order does not arrive within the time frame specified. Once we have been notified that an order has not arrived by the due date we will immediately lodge an enquiry with the international freight carrier to ensure delivery occurs as soon as possible. Without limiting the operation and any other terms and conditions herein, CanCertain Ltd will not accept liability for any issue that may arise due to the late delivery of a Test Kit. By agreeing to these CanCertain Ltd Terms And Conditions, you also accept and agree that late delivery does not constitute a failure of our agreement and does not entitle you to the cancellation of an order. Deliveries are on business days only (i.e. Monday – Friday) and not on Public Holidays.

21. Viability of a Blood Sample:
Laboratories check the viability of a blood sample before commencing testing. Should a blood sample be deemed not viable, CanCertain Ltd will launch an investigation to determine where the responsibility lies. If it is found to be your responsibility then there may be extra costs associated to cover administration, freight and replacement of the Test Kit. If it is found to be the responsibility of the CanCertain Ltd’ contracted freight company, then we will dispatch another Test Kit to the customer at no additional cost, and the customer will need to redraw another blood sample at the customer’s own expense.
